1. Acceptance of Terms

By downloading, installing, or using Treadmill Pro (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download or use the App.

The App is operated by SupafastTech LLC, a limited liability company registered in the State of Delaware, USA ("we", "us", "our").

Eligibility

You must be at least 13 years of age (or 16 in the EEA) to use the App. By using the App, you represent that you meet this requirement. If you are using the App on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. License to Use the App

Subject to these Terms, SupafastTech LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial fitness purposes, in accordance with Apple's App Store Terms of Service.

You may not:

Copy, modify, adapt, translate, or create derivative works of the App;
Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App;
Rent, lease, lend, sell, sublicense, or otherwise transfer the App to any third party;
Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) in or on the App;
Use the App for any unlawful, harmful, fraudulent, or unauthorized purpose.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at treadmill@supafast.tech if you suspect unauthorized use of your account. We are not liable for any loss resulting from unauthorized access to your account where you have not taken reasonable steps to protect your credentials.

4. Subscriptions and In-App Purchases

4.1 Pro Subscription

Treadmill Pro offers a Pro tier available as a monthly subscription, annual subscription, or a one-time lifetime purchase. All purchases and subscriptions are processed through Apple StoreKit and billed to your Apple ID account. We do not collect or store your payment information.

4.2 Auto-Renewal

Monthly and annual subscriptions automatically renew at the end of each billing period at the then-current subscription price, unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

4.3 Managing and Cancelling Subscriptions

You can manage or cancel your subscription at any time through your Apple ID account settings: go to Settings → [your name] → Subscriptions on your iPhone or iPad. Cancellation takes effect at the end of the current billing period; you will retain Pro access until that date.

4.4 Refunds

All refund requests for App Store purchases are handled exclusively by Apple in accordance with Apple's App Store refund policy. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com.

4.5 Price Changes

We reserve the right to change subscription pricing with reasonable notice. Apple will notify you before any price change takes effect for your subscription, and you will have the opportunity to review and accept the new price or cancel.

5. Safety Disclaimer and Assumption of Risk

Please read this section carefully. It contains important safety information.

5.1 Inherent Risk of Exercise and Treadmill Use

Using a treadmill and engaging in physical exercise carry inherent risks, including the risk of physical injury, cardiac events, falls, and other harm. Controlling a treadmill through Bluetooth software introduces additional variables, including potential connectivity interruptions. By using the App, you acknowledge and voluntarily assume all risks associated with using the App to control, monitor, or interact with treadmill equipment.

5.2 Your Responsibilities

Always read and follow the safety instructions provided by your treadmill manufacturer. Keep the safety key (emergency stop clip) attached to your clothing while using any motorized treadmill.
Ensure that your treadmill is properly assembled, in good working condition, and on a stable, level surface before use.
Keep children and pets away from moving treadmill equipment at all times.
Stop exercising immediately if you feel pain, dizziness, shortness of breath, or any other discomfort, and consult a healthcare professional.
Consult a physician or qualified healthcare provider before beginning any new exercise program, especially if you have a pre-existing medical condition, cardiovascular disease, or other health concern.

5.3 No Medical Advice

The App is a fitness control and tracking tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Heart rate data, calorie estimates, and other fitness metrics displayed by the App are provided for informational purposes only and should not be relied upon for medical decisions. Always seek the advice of a qualified healthcare professional for any medical concerns.

5.4 Emergency Stop

The App provides Bluetooth-based speed and incline control. Bluetooth connectivity may be interrupted by distance, interference, or device limitations. Never rely solely on the App to stop your treadmill in an emergency. Always use your treadmill's physical emergency stop mechanism (safety key or stop button) for immediate halts.

6. Third-Party Treadmills and Trademarks

Treadmill Pro is designed to work with treadmill equipment manufactured by third parties. SupafastTech LLC is not affiliated with, endorsed by, sponsored by, or in any way officially connected with any treadmill manufacturer, including but not limited to Bowflex, NordicTrack, WalkingPad, KingSmith, Xiaomi, iFIT, Gymax, BH Fitness, Bluefin, or any other brand.

All brand names, product names, logos, and trademarks mentioned in the App or on this website are the property of their respective owners. References to third-party treadmill brands and models are made solely to indicate the App's Bluetooth compatibility with those products and do not imply any partnership, affiliation, or endorsement.

SupafastTech LLC is not responsible for any damage to third-party equipment caused by use of the App, nor for any warranty implications arising from the use of Bluetooth-based third-party software with your equipment.

7. Intellectual Property

The App, including its source code, design, graphics, user interface, and all content, is owned by SupafastTech LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights in the App other than the limited license set out in Section 2. All rights not expressly granted are reserved.

If you provide feedback, suggestions, or ideas about the App, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.

8. Acceptable Use

You agree not to use the App in any way that:

Violates any applicable law or regulation;
Interferes with, disrupts, or damages the App or its underlying infrastructure;
Attempts to gain unauthorized access to any part of the App or its related systems;
Transmits any malware, viruses, or other harmful code;
Circumvents any security feature or license verification mechanism in the App.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUPAFASTTECH LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses; that defects will be corrected; or that the App will be compatible with all devices, iOS versions, treadmill models, or Bluetooth environments. Treadmill compatibility information is provided on a best-efforts basis and may change without notice due to firmware updates by treadmill manufacturers.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUPAFASTTECH LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH:

Your use of or inability to use the App;
Any treadmill malfunction, Bluetooth connectivity failure, or equipment damage;
Personal injury or physical harm sustained during exercise or treadmill use;
Any unauthorized access to or alteration of your data;
Any other matter relating to the App.

IN NO EVENT WILL SUPAFASTTECH LLC'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless SupafastTech LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any injury or property damage caused by your treadmill use.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms, or for any other reason at our sole discretion. You may stop using the App and delete it at any time. Upon termination, the license granted in Section 2 ceases immediately. Sections 5, 9, 10, 11, 13, and 14 survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the App will be resolved exclusively in the state or federal courts located in the State of Delaware, and you consent to personal jurisdiction in those courts.

If you are a consumer in a jurisdiction that requires disputes to be resolved in your local courts (such as under EU consumer protection laws), nothing in this section limits your statutory rights to bring claims before courts in your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where required, notify you through the App. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, stop using the App.

15. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SupafastTech LLC regarding the App and supersede all prior agreements.
Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
No Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of the right to enforce it in the future.
Assignment: You may not assign your rights or obligations under these Terms. We may assign ours without restriction.
